The new law also contains a notification requirement for products containing intentionally added PFAS.<\/p>\n<p>Under the new law, PFAS is defined as a class of fluorinated organic chemicals 2032<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<h3>Washington adopts new restriction and reporting rule under safer products program<\/h3>\n<p>The Safer Products Program for the State of Washington implements the Toxic Pollution law (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=70A.350&amp;full=true\" target=\"_blank\" rel=\"noopener\">Chapter 70A.350 RCW<\/a>), which was signed in 2019 to create a pathway to keep toxic chemicals out of the environment.\u00a0Under the Safer Products Program, there is a four phase implementation process to:<\/p>\n<ul>\n<li>Designate priority chemicals;<\/li>\n<li>Identify consumer products that contain these chemicals;<\/li>\n<li>Decide whether to regulate those chemical-product combinations by requiring reporting or chemical restrictions; and<\/li>\n<li>Adopt rules to implement those regulatory actions.<\/li>\n<\/ul>\n<p>On May 31, 2023, the State of Washington adopted\u00a0<a href=\"https:\/\/www.sgs.com\/-\/media\/sgscorp\/documents\/corporate\/brochures\/safeguards-table\/chapter-173-337-wac--safer-products-restrictions-and-reporting-final-rule.cdn.en.1.ashx\" target=\"_blank\" rel=\"noopener\">Chapter 173-337 WAC \u2013 Safer Products Restrictions and Reporting<\/a>\u00a0to require manufacturers to restrict or report:<\/p>\n<ul>\n<li>PFAS in aftermarket stain- and water-resistance treatments, carpets and rugs, and leather and textile furnishings;<\/li>\n<li>Ortho-phthalates in vinyl flooring and in personal care product fragrances;<\/li>\n<li>Organohalogen flame retardants in electric and electronic products;<\/li>\n<li>Flame retardants in recreational polyurethane foam; and<\/li>\n<li>Phenolic compounds in laundry Bill\u00a0<a href=\"http:\/\/www.mainelegislature.org\/legis\/bills\/getPDF.asp?paper=HP0138&amp;item=3&amp;snum=131%C2%A0%C2%A0\" target=\"_blank\" rel=\"noopener\">HP 138 \u2013 LD 217<\/a>\u00a0to amend the PFAS reporting law,\u00a0<a href=\"https:\/\/www.mainelegislature.org\/legis\/bills\/getPDF.asp?paper=HP1113&amp;item=5&amp;snum=130\" target=\"_blank\" rel=\"noopener\">Public Law c. 477 \u2013 An Act To Stop Perfluoroalkyl and Polyfluoroalkyl Substances Pollution<\/a>.<\/p>\n<p>Under the amendment, the following changes were made to the original PFAS reporting
