Cosmetics Californian PFAS regulation

Signed into law on 29 September 2022, the State of California passed Bill AB 2771 to regulate per and polyfluoroalkyl substances (PFAS) chemicals in cosmetic articles. This new law, along with its related legislation, AB 1817 for textile articles, means that California is at the leading edge of legislation against what some term “forever chemicals”.

PFAS is a man-made class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom which can show high levels of toxicity and persists in the ecosystem.

Californian AB 2771 effect on the supply chain

  • AB 2771 comes into force on 1 January 2025 and will prohibit the manufacture, distribution, or sale of any cosmetic product (article) in the state of California that contains intentionally added PFAS.
  • AB 2771 and AB 1817 will also require a manufacturer to provide persons placing the product on the market, whether it be sale or distribution, to offer a certificate of compliance stating that the article is in compliance with these Bills and does not contain any regulated PFAS.

PFAS definition under AB 2271

Either

PFAS that is intentionally added to a product and that have a functional or technical effect in the product, including the PFAS components of intentionally added chemicals and PFAS that are intentional breakdown products of an added chemical that also have a functional or technical effect in the product

or

The presence of PFAS in a product or product component at or above the following thresholds, as measured in total organic fluorine

  • Beginning 1 January 2025, 100 ppm
  • Beginning 1 January 2027, 50 ppm
